March 2015. Publication of Draft Decree Creating the Companies Shareholders’ Registry

The Tax Authorities published on January 16th, a draft of the Executive Decree: "Creation of the Companies Shareholders’ Registry" (the Decree) with the aim of establishing a shareholders’ database of all the registered companies with the Commercial Registry of the National Registry.

For this purpose, each company must report the name and identification of the shareholders, number, value of shares, their percentage of ownership and date of acquisition of the shares; notwithstanding that the Tax Authorities may eventually modify in the future the information to be supplied.   Likewise it shall be informed when changes occur in the ownership of shares.

March 2015. Updating the economic limits of Government Contracting and Procurement.

Updating the economic limits established by subsections a) thru j) of articles 27 and 84 of the Public Procurement Act and its reforms.

Adjustment of thresholds established by Annex 9.1.2. (B) (I) of Chapter Nine of the Free Trade Agreement Dominican Republic- Central America –United States

 

On February 27 this year the official journal La Gaceta published the resolution R-DC-19-2015 from the Comptroller General of the Republic which dictates the limits of administrative procurement procedures for the purchase of goods and services required by various authorities of the Costa Rican government.

The financial limits are set as assign by the articles 27 and 84 of the Public Procurement Act. When the law does not provide, the article 27 indicates guidelines by which the procedure is determined by the authorized budget. The article 84 establishes the quantum to bring the appeal to the General Comptroller against the award decision, that is to say the coverage of the appeal and the competent board are determined.

Febr. 2015 Bill of Law to amend Clinical Research Law in Costa Rica

On October 14th , 2014, congressman Oscar López (PASE minority Party)  presented a Bill of Law in order to ban biomedical research on minors and people suffering volition disabilities.

The following institutions and governmental agencies were summoned  to a hearing at Congress, and all of them REJECTED this initiative alleging discrimination towards minors and disable victims:

  • National Council of Health Research (CONIS
  • Ombudsman Agency
  • Physicians and Surgeons Association
  • INCIENSA

Jan. 2015 Apollo Endosurgery will start operations in Costa Rica

As it was announced by the Costa Rican Investment Promotion Agency ">http://www.cinde.org/en/news/press-release/apollo-endosurgery-inc-to-start-operations-in-costa-rica the US company Apollo Endosurgery, Inc. (http://apolloendo.com/),  specialized in bariatric and gastrointestinal devices, confirmed the selection of Costa Rica to install its new manufacturing facility at Coyol Free Zone  in the province of Alajuela. In its new site, Apollo will develop industrial processes for a variety of products that will be distributed from Costa Rica to several markets around the world, including the LAP - BAND® System - the only device approved by the FDA for weight reduction. For the start of operations in 2015, approximately 40 people will be hired to work at the floor of 1,750 m2.
